By registering or using the service you confirm that you have read, understood and accepted these Terms without reservation. If these Terms and the Greek version differ, the Greek version prevails.

CactusCRM is a customer relationship management (CRM) platform provided as Software as a Service. It covers, among other things, leads & opportunities, documents, appointments, project management, ticketing, social media content planning, approval and publishing, AI insights, and integrations with third-party services (ERP, email, payments, social media platforms and more).
The exact scope of the Service, its modules, integrations and usage limits are set out in the Offer / Contract signed with the Customer.
3. Accounts & access
- Accounts must be created with accurate and complete information.
- The Customer is solely responsible for keeping access credentials safe and for every action taken through its account.
- If unauthorised access is suspected, the Customer must notify us immediately at info@cactusweb.gr.
- We may suspend or terminate accounts that breach these Terms.
4. Acceptable use
You agree not to use the Service:
- For unlawful purposes or in breach of third-party rights.
- To send spam, malware or phishing messages.
- To attempt to bypass security measures, reverse engineer the Service or gain unauthorised access.
- To overload our systems or APIs beyond the agreed usage limits.
- To publish content that breaches the rules of a connected social media platform.
- To process special categories of data (e.g. health data) without the appropriate contract and the necessary additional safeguards.
5. Fees & invoicing
- Fees (subscription, implementation, customisation, integrations, training) are set out in writing in the mutually accepted Offer / Contract.
- All prices are in euros (€) and exclude VAT, unless stated otherwise.
- Invoicing is monthly or yearly, in advance. Invoices are payable within 14 days of issue.
- If a payment is more than 30 days late, we may suspend access to the Service until it is paid.
- Any change in fees is announced at least 60 days before it takes effect.
6. Term & termination
- The contract starts when the account is activated and lasts for the period set out in the Offer / Contract. Without an explicit agreement, it renews monthly.
- Either party may terminate the contract without cause, with 30 days' written notice.
- If the Customer materially breaches the contract (e.g. non-payment, unlawful use), we may terminate it immediately.
- After termination, the Customer may request an export of its Data within 30 days. The data is then deleted permanently within 90 days, unless the law requires a longer retention period.
7. Availability & support
We make reasonable efforts to keep the Service available at least 99.5% of the time each month, excluding scheduled maintenance, which we announce in advance.
Technical support is provided on working days (Monday to Friday, 10:00-18:00 EET) by email or ticketing. Extended SLAs are available in specific packages.
8. Customer data
- The Customer remains the sole owner and controller of its Data.
- The Company acts as processor in line with the Social Media Privacy Policy, the Privacy Policy (in Greek) and the GDPR page (in Greek).
- We create encrypted daily backups and keep them for a limited period.
- The Customer confirms that it has the appropriate legal basis and the necessary consents for the personal data it enters into the Service.
9. Connected social media accounts
- Through the client portal, the Customer can connect its Facebook Pages, Instagram, TikTok, YouTube and LinkedIn accounts. Only someone authorised to manage those accounts may connect them.
- By connecting an account, the Customer authorises us to read the account details and statistics needed for the Service, and to publish on the Customer's behalf only content the Customer has approved in the client portal. We never publish content that has not been approved.
- The Customer is responsible for the content it approves and confirms that it holds the rights to the texts, images, videos and music it contains.
- The Customer can revoke access at any time, from the portal or from the platform itself, as described in the Data Deletion Instructions. After revocation we can no longer read or publish anything.
- Use of each platform is also subject to its own terms, for example the Meta Terms, the TikTok Terms of Service, the YouTube Terms of Service and the LinkedIn User Agreement. We are not responsible for changes, outages or decisions of those platforms (e.g. rejected or removed posts).
10. Intellectual property
All rights in the Platform, the source code, the design, the logos, the trademarks "CactusCRM" and "CactusWeb", the texts, images and documentation belong exclusively to the Company or its lawful licensors.
The Customer is granted a non-exclusive, non-transferable licence to use the Service for as long as the contract lasts. Copying, reselling, reverse engineering or creating derivative works is not allowed without written consent.
The Customer keeps all rights in its Data and in any customisations developed exclusively at its request and invoiced as custom development.
11. Limitation of liability
The Service is provided "as is" and "as available". To the maximum extent permitted by law:
- We do not guarantee that the Service will be completely free of errors or interruptions.
- We are not liable for indirect, consequential or incidental damages (e.g. loss of profits, customers or reputation).
- Our total liability for any claim related to the contract is limited to the amount the Customer paid for the Service in the 12 months before the event that caused the damage.
These limitations do not apply to wilful misconduct, gross negligence, or liability that mandatory law does not allow to be limited.
12. Force majeure
We are not liable for delays or failure to perform our obligations caused by force majeure, such as natural disasters, pandemics, network outages, cyber attacks, decisions of authorities or strikes.
13. Changes to these terms
We may change these Terms. Significant changes are announced by email or by a prominent notice on the Platform at least 30 days before they take effect. Continuing to use the Service after that date means you accept the new Terms.
14. Governing law & jurisdiction
These Terms are governed by Greek law. The courts of Thessaloniki have exclusive jurisdiction over any dispute.
Before any legal action, the parties agree to try to settle the matter amicably in writing within 30 days.
